These Terms of Service ("Terms") govern your access to and use of the Floor Engine service provided by FlooringAcquisition.com ("we," "us," or "our"). By engaging our service, signing our agreement, or submitting payment, you ("Client" or "you") agree to be bound by these Terms. If you do not agree, do not use our service.
Floor Engine is a pay-per-appointment lead-generation system for residential flooring contractors in the United States. We build and operate a marketing funnel on your behalf, run advertising campaigns (primarily through Meta Ads), pre-qualify prospective homeowners, and book confirmed appointments into your calendar. Our service delivers appointments — it does not guarantee closed sales, signed contracts, or any specific revenue outcome, all of which depend on your own sales process and workmanship.
Our service is available only to businesses that meet all of the following criteria:

A "Confirmed Appointment" means a prospective customer who has:
Prospects who do not meet all three conditions are not counted as Confirmed Appointments.
Pricing, guarantee terms, and investment details are discussed and agreed upon during the onboarding call prior to engagement. The specific fees, performance guarantee, advertising budget, and any related refund terms applicable to your engagement will be set out in the written agreement entered into between you and us at that time.
You are responsible for paying advertising costs directly to the applicable advertising platform. All fees are stated in U.S. dollars (USD) and are exclusive of any applicable taxes.
To receive the full benefit of the service and remain eligible for any applicable guarantee, you agree to:
To the maximum extent permitted by law, our total aggregate liability arising out of or relating to the service shall not exceed the total fees you paid to us in the three (3) months preceding the event giving rise to the claim. In no event shall we be liable for any indirect, incidental, special, consequential, or punitive damages, including lost profits, lost revenue, or lost business opportunities, even if we have been advised of the possibility of such damages. We do not warrant any specific sales, close rate, or revenue result; our obligation is limited to the delivery of Confirmed Appointments as defined in these Terms.
Either party may terminate the engagement in accordance with the terms of the signed agreement between the parties. Upon termination, you remain responsible for any fees accrued for Confirmed Appointments delivered prior to termination, and we will cease running campaigns on your behalf. Sections relating to payment, limitation of liability, and governing law survive termination.
These Terms are governed by and construed in accordance with the laws of the Province of Quebec, Canada, without regard to its conflict-of-laws principles. Any dispute arising out of or relating to these Terms shall be subject to the exclusive jurisdiction of the courts located in the Province of Quebec, Canada.
We may update these Terms from time to time. When we do, we will revise the "Last updated" date at the top of this page. Your continued use of the service after changes take effect constitutes acceptance of the revised Terms.
